How does the Intellectual property infringement reporting process work for the Samsung Galaxy Store?

If the reported publisher is the lawful copyright owner of or has the right to post the reported content, the publisher may prepare evidence and submit a counter notice to Samsung within ten (10) business days that includes (a) the publisher’s physical or electronic signature; (b) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled; (c) a statement under penalty of perjury that publisher has a good faith belief that the material was removed or disabled as a result of mistake or misidentification; (d) the publisher’s name, address and telephone number and consent to jurisdiction and agreement to accept service of process from the party who reported the content. This counter notice is forwarded to the reporter. The reporter must declare within 10 business days of receiving the counter notice that the reporter has filed an action seeking a court order to restrain the publisher. If there is no statement by the deadline, access to the reported content in the Samsung Galaxy Store may be restored.
• If seller has received a trademark infringement report
If the reported publisher is the lawful trademark owner of or has the right to post the reported content, the publisher may prepare evidence and attempt to resolve the matter directly with the reporter.
• (UK, Europe only) If seller has received a registered or unregistered design right (also called a design patent) infringement report
If the reported publisher is the lawful owner of or has the right to post the reported content, the publisher may prepare evidence and attempt to resolve the matter directly with the reporter.

• If you submit a false report on a suspected copyright infringement, you may be held liable for damages in accordance with the Digital Millennium Copyright Act (DMCA) Article 512(f) or similar laws in other countries.
• If you submit a false report on a suspected trademark or other infringement, you may be held liable for damages in accordance with laws in each country.
